Website Terms and Conditions
1. About these terms
This website is operated by Cleverain Pty Ltd (Cleverain, we, us or our). These terms govern use of our website, including enquiries, applications and information submitted through it.
Our executive search, recruitment and broader business services are subject to separate agreements. These website terms do not replace those agreements or establish recruitment fees, payment obligations or placement guarantees.
Simply visiting our website or submitting an enquiry does not engage Cleverain to provide paid services.
2. Website information
The information on this website is general in nature. It is not tailored professional, legal, financial, investment or tax advice. Please seek appropriate advice before making decisions based on website content.
We take reasonable care when preparing and updating information. However, job details, market information and service descriptions may change. Please contact us to confirm information relevant to your circumstances.
3. Applications and submissions
Submitting a CV, application or expression of interest does not guarantee an interview, representation, offer or placement. It does not create an employment relationship with Cleverain.
Information you provide should be accurate, current and not misleading. Please tell us about material changes relevant to an application, including your qualifications, experience, availability or work rights.
You must have authority to submit information about another person and must not provide material that infringes intellectual property rights or confidentiality obligations.
You retain ownership of materials you submit. We handle personal information as explained in our Privacy Policy.
4. Acceptable use
You must use this website lawfully and must not:
- impersonate another person or submit fraudulent, abusive or unlawful material
- introduce malicious software, attempt unauthorised access or interfere with website security or operation; or
- collect personal information from the website without authorisation or use it to send unlawful unsolicited communications.
We may reasonably restrict access where necessary to address unlawful activity, a security risk or a material breach of these terms.
5. Intellectual property
Cleverain and its licensors retain applicable intellectual property rights in the website’s content, design, branding, images and other materials.
You may view, download or print content for personal use or internal business reference, provided ownership notices remain intact.
Except as permitted by law or with our written permission, you must not reproduce, modify, republish, sell or commercially exploit our content, or use our branding in a way that suggests an unauthorised association with Cleverain.
6. Privacy and external websites
Our Privacy Policy explains how we collect, use, store and disclose personal information, including information submitted through website forms and applications.
The website may link to third-party websites or platforms. These operate independently and have their own terms and privacy policies. A link does not, by itself, imply that Cleverain endorses the website or its services.
7. Availability and liability
We take reasonable steps to maintain the website, but access may occasionally be interrupted by maintenance, technical issues or circumstances outside our reasonable control. We cannot promise uninterrupted or error-free access.
Nothing in these terms excludes, restricts or modifies rights, guarantees or remedies that cannot lawfully be excluded, including under the Australian Consumer Law.
We are not responsible for loss to the extent it is caused by your unlawful use of the website. These terms do not exclude liability arising from our negligence, fraud or wilful misconduct.
8. Updates to these terms
We may update these terms to reflect changes to the website, our operations or legal requirements. Updated terms will be published on this page with a revised date.
Changes apply prospectively and do not alter existing service agreements or rights that have already arisen.
9. Governing law
These terms are governed by the laws of Queensland, Australia.
You and Cleverain submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from those courts.
Nothing in this clause limits any rights or protections that cannot lawfully be excluded.
